These Terms of Service (“Terms”) govern your use of the PFM mobile application and related services (collectively, the “Service”) provided by Avishkaram (“we”, “us”, or “our”). By downloading or using PFM you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use PFM. By using the Service you represent that you meet this requirement. If you are under 18, you confirm that you have permission from a parent or legal guardian.
2. Account Registration
You may register with an email address and password, or via Google Sign-In. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at gyanendra.chaudhary@avishkaram.com if you suspect unauthorized access.
3. Free Plan and PFM Pro
PFM is available at no charge under the Free plan, which includes one active owned account and core expense tracking features.
PFM Pro is a paid subscription available through Google Play on Android. Pro unlocks unlimited accounts, budgets, categories, recurring expenses, attachments, CSV export, bulk import, multi-currency tools, and AI insights.
- Subscriptions are billed on a recurring basis as shown at the time of purchase.
- Payment is charged to your Google Play account upon confirmation of purchase.
- Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period.
- You can manage and cancel your subscription in the Google Play Store under “Subscriptions”.
- Refunds are handled according to Google Play’s refund policy. We do not process refunds directly.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of applicable laws.
- Attempt to gain unauthorized access to any part of the Service or another user’s account.
- Upload malicious files, viruses, or harmful content.
- Reverse-engineer, decompile, or disassemble any part of the Service.
- Use automated tools to scrape, crawl, or excessively load the Service.
- Impersonate another person or entity.
5. Shared Accounts
PFM allows you to invite other users to shared accounts. As the account owner you are responsible for managing member access. Members you invite can view and add data within the shared account. You should only invite people you trust. We are not liable for actions taken by members of your shared accounts.
6. User Content
You retain ownership of the financial data, files, and other content you create or upload in PFM (“User Content”). By using the Service you grant us a limited, non-exclusive, royalty-free licence to store, process, and transmit your User Content solely to provide and improve the Service. We do not claim any ownership over your User Content.
You are solely responsible for the accuracy and legality of your User Content. We do not verify or endorse any financial information you enter.
7. AI Insights
PFM Pro includes AI-powered spending insights generated by Google Gemini. These insights are provided for informational and organizational purposes only. They do not constitute financial, investment, tax, or legal advice. Always consult a qualified professional for financial decisions.
8. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to fitness for a particular purpose, accuracy, or uninterrupted availability. We do not guarantee that the Service will be error-free or that your data will never be lost.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Avishkaram and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or profits, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or USD 10, whichever is greater.
10. Indemnification
You agree to indemnify and hold harmless Avishkaram and its affiliates from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.
11. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service, with reasonable notice where practicable. Sections 6, 8, 9, and 10 survive termination.
12. Changes to These Terms
We may update these Terms at any time. We will notify you of material changes through the app or by email. Your continued use of the Service after the effective date of the revised Terms constitutes acceptance of the changes.
13. Governing Law
These Terms are governed by the laws of Nepal, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Nepal.
